Why do we need council approved building plans?

This is a common question, with a somewhat complex answer.
Building plans and occupational certificates are legal requirement according The National Building Regulations and Building Standards Act (no 103 of 1977). Stipulating that no person may erect, alter, add to, or convert any building without the prior approval of the Local Authority.
So, what are the implications of non-compliance?
If you are serious about selling your property, then it is vital that all the relevant information about the property is available to a potential buyer. Misrepresentation can be constituted by withholding information about structures that have no approved building plans and therefore no occupational certificates. This can lead to the cancellation of the property sale. If the seller is aware that there are no plans, and has made alterations or extensions with out plans, and he deliberately does not disclose this fact (with the intention to defraud the purchaser), the seller cannot hide behind the voetstoots clause. the voetstoots clause is only relevant for latent defects.
But I am not selling my house, and probably never will, so why bother?

One word – Insurance.
Most policy wording reads as follows:
“Your Homeowners Comprehensive insurance policy should cover the full replacement cost of your property. the replacement cost is the cost to replace your property to its former condition, should an insured event happen. This is
different to the market value of your property.
Read further in the policy documentation (home insurance) for the clause that states: ‘Dwelling – means the physical structure of your private residence and domestic outbuildings, identified as the risk situation in your certificate, built in accordance with the National Building Regulations as amended and constructed as indicated in your certificate’, or something similar depending on your home owner’s insurance provider.
